TERMS AND CONDITIONS OF USE
Titularice S.A. Sociedad Titularizadora de Activos No Hipotecarios ("Titularice"), through: Titularice.com (the "Site") presents institutional information of interest to the general public and visitors to the Site (the "Users").
Titularice invites all Users of the Site to read these Terms of Use carefully.
1. Acceptance of Terms of Use
The mere access to the Site implies the total and integral acceptance of the User to the Terms of Use and its updates and the other conditions and regulations defined by Titularice for its use. Titularice reserves, without limitation and in any case, the right to update and modify at any time and in any way, unilaterally and without prior notice, the Terms of Use and the contents of the Site. Given the binding nature of the Terms of Use, it is the sole responsibility of the User to review from time to time the Terms of Use in force at any given time.
2. Conditions of Use
Unless expressly stated otherwise, access to the information on the Site is free and unrestricted. Notwithstanding the foregoing, Titularice in no case guarantees permanent and uninterrupted access to the Site, or that this access will be free of errors or viruses or other harmful agents. When the User accesses the Site, it shall be the User's responsibility to take the pertinent measures to avoid and/or correct the undesired effects of such agents. The User agrees to use the content of this Site solely and exclusively for lawful activities and to use the information made available through the Site subject to the Terms of Use. The information contained in the Site may under no circumstances be used for commercial purposes. The use of the Site by the User implies the prohibition to transmit, publish or communicate any type of illegal or prohibited information in the terms defined for the effect in the Colombian legislation. Likewise, the User undertakes not to insert or transfer to the Site obscene, misleading, inaccurate, defamatory materials or materials that violate the intellectual property rights of Titularice or that may negatively affect data, software or the operation of any computer equipment. The User who accesses the Site does so under his/her own responsibility, for which reason Titularice shall not be liable for possible damages caused to the User or to third parties by accessing or using the Site, for the loss of information or for the impossibility of using the Site or the information contained therein, circumstances that in all cases shall be considered as force majeure or fortuitous event. The Site will include, at Titularice's discretion, linked sites, which are provided merely for informational purposes; the inclusion of these linked sites on the Site does not imply Titularice's endorsement, recommendation or affiliation with any of these sites or any association with their operators. In this sense, Titularice shall in no event be responsible for the information and contents of the linked sites, nor for their accessibility or permanent or discontinued availability. Titularice informs that the official language of the Site is Spanish and that the Site has translation of some contents into English. Therefore, any difference that may exist between the contents in Spanish and the translated ones must be resolved by consulting the texts and documents in Spanish.
Nature of the information
The information that the User can access in the Page is of an exclusively informative nature and therefore cannot be understood as a legal advice, recommendation or business suggestion or of any other type for the taking of investment decisions or the realization of any type of transactions. The contents of the Page are purely informative and do not constitute an offer, nor a firm demand, for the execution of transactions. In no case can the information contained in the Page be considered as a financial or legal opinion or as a business or investment recommendation by Titularice. Nor can it be considered as an invitation to do business or as an offer to buy or sell any security. In no case Titularice assumes responsibility for the investment decisions made, or the result of any transaction made by the addressees or third parties, on the information contained in the Site. Such responsibility is exclusive of the Users who make use of it.
4. Intellectual Property
Titularice is the owner of the copyrights and intellectual property rights over the distinctive signs in general, trademarks, service marks and in general everything that appears on the screen, as well as over the information and material contained in the Site, unless otherwise indicated. In development of the foregoing, the User undertakes not to distribute, sell or commercialize, and in general not to dispose by any means of the information contained in the Page, totally or partially, under penalty of incurring in liabilities for violation of copyrights, according to the regulations in force, unless there is prior and written authorization from Titularice. The User may make a copy of its content, exclusively for non-commercial uses, provided that all copyright notices are kept intact and the source is cited. Under no circumstances should it be understood that the acceptance of the Terms of Use of this document grants an authorization of use or license on the contents of the Site or its links.
5. Limitation of liability
Any damage, loss or harm suffered by the User or third parties derived from the access to the information contained in the Site as a consequence of the interpretation or misuse of the information or in general for executing any type of operation through the Site, is assumed by the User and therefore declares Titularice harmless and free from any liability. Likewise, the User releases Titularice from any liability for damages that may occur to the hardware and software, or any electronic device through which the access to the Site is achieved. In no event shall Titularice be liable for damages, including but not limited to direct, indirect, special, or incidental damages, nor for loss of information or expenses that may arise from the connection to the Site, for the use made of the same, for the impossibility of making use of the information of the Site or in general for any failure in the execution, error, omission, interruption, defect, delay in the transmission or connection, or for the existence of a virus in the computer or for system or line failures, or for its suspension or termination.
6. Notifications
All notifications, requirements, requests and other communications required to be made by Users in connection with the Terms of Use must be made in writing and sent by certified mail to the following address: Avenida 100 No. 13-95, Piso 11, Oficina 11 Norte, Bogotá (Colombia).
7. Applicable law and competent jurisdiction.
The policies and conditions of access and use set forth herein and the conflicts that may arise with respect to their interpretation, use, scope and termination are governed by Colombian law and are subject to the Colombian judges and courts.
